Avi-Go data shows that European business aviation recorded 660,455 flight movements throughout 2024, totaling approximately 996,548 flight hours, with an average sector duration of approximately 90.5 minutes and a peak of 75,611 movements in July alone. This substantial operational volume now faces a regulatory ruling that could profoundly reshape the industry's financing landscape. According to AIN, the Court of Justice of the European Union is set to issue a ruling on whether business aviation qualifies as an "environmentally sustainable economic activity" under the EU Taxonomy Regulation (2020/852). If business aviation is excluded, banks within the EU will be unable to classify business jet financing as "green investments," ESG funds may be compelled to divest related assets, and the use of business jets by large listed companies will generate negative compliance indicators in their CSRD reporting. Meanwhile, the European business aviation fleet is projected to grow from over 4,200 aircraft in 2026 to nearly 5,300 aircraft by 2035 (CAGR of 2.4%). Should the ruling take effect, it will create policy linkages with the expansion of EU ETS and the mandatory SAF blending requirements under ReFuelEU, with compliance cost pressures extending throughout the entire fleet expansion cycle.

Impact: For operators and fleet financiers, the loss of the green label will directly increase financing costs, and certain asset acquisition plans reliant on ESG bonds or green loans may be forced into suspension or repricing. For OEMs, SAF compatibility and carbon efficiency improvements will shift from differentiating factors to baseline entry requirements, placing pressure on the reprioritization of new aircraft development programs.

Recommendation: Operators should complete a compliance review of their existing financing structures before Q3 2026, identify debt exposures sensitive to the green label, and proactively negotiate terms adjustment arrangements with lenders. At the same time, operators should closely monitor the progress of the ruling and, once the outcome is clear, immediately initiate revisions to business jet usage policies under the CSRD disclosure framework, so as to avoid being caught in a reactive position during the annual reporting season.
